| About this law: The Indian Child Welfare Act, enacted by Congress in 1978, is a Federal law that is to take precedence over any local adoption laws within the United States of America. This law entitles all American Indian Nations and Tribes, including Alaskan Natives, their right to control and be involved in adoptions that involve American Indian children who are members of their tribes and nations. This includes children who are eligible for enrollment with their respective tribes and nations. Should any state laws conflict with the Indian Child Welfare Act, it is to be recognized that the ICWA law prevails. |
